By accessing or using Barqly, you agree to these Terms of Service. These terms apply to visitors to the website and to users of the Barqly customer, vendor, and rider apps.

If you do not agree to these terms, you should not use the platform.

You must provide accurate, current, and complete information when creating or using a Barqly account. You are responsible for activity that occurs through your account, including activity carried out using your verified phone number or login credentials.

• Keep your login credentials and OTP access secure.
• Use the correct app for your role: customer, vendor, or rider.
• Promptly update inaccurate or outdated profile information.
• Do not create accounts on behalf of another person without authorization.

Barqly provides software, routing, communication, payment, support, and operational tools that help customers place orders, vendors manage fulfillment, and riders complete deliveries.

Vendor partners remain responsible for their menus, inventory, product descriptions, pricing accuracy, preparation quality, packaging, and lawful business operation. Riders remain responsible for safe and compliant delivery behavior. Barqly may intervene operationally where needed to support reliability, trust, and user safety.

Customers are responsible for providing correct delivery details, reachable phone numbers, valid addresses, and clear order instructions where needed.

• Orders may be declined, reassigned, delayed, or cancelled if items are unavailable, an address is outside service range, a vendor is offline, a rider cannot safely complete the delivery, or there is suspected abuse.
• Delivery times shown in the platform are estimates, not guarantees, although Barqly aims to keep them reliable.
• Some deliveries may require OTP confirmation or other proof-of-delivery steps before completion.
• If contact details or address information are incorrect, the order experience may be affected and Barqly may not be responsible for resulting delays or failed handoff attempts.

Orders may include product prices, delivery fees, platform fees, taxes where applicable, tips, discounts, and promotional adjustments. By placing an order, you authorize Barqly and its payment partners to process the selected payment method.

• Supported payment methods may vary by order flow, geography, or app version.
• Payment verification, reconciliation, and refund handling may depend on third-party payment providers such as Flutterwave.
• Refunds, credits, or reversals are not automatic in every case and may depend on payment status, vendor confirmation, fraud checks, support review, and applicable policy.
• Cash orders may require confirmation and collection controls before they are considered fully settled.

Promotional offers, referral codes, discounts, and wallet or credit features may be limited by time, geography, account type, and abuse controls.

Barqly may modify, suspend, or withdraw promotions where misuse, fraud, technical error, or operational risk is detected.

Vendors using Barqly agree to:

• Provide accurate menu, pricing, stock, and operating information.
• Prepare orders safely, lawfully, and to an acceptable quality standard.
• Keep store, banking, and verification information accurate and current.
• Respond to live orders and operational notices in a timely way.
• Comply with food safety, tax, licensing, and other legal obligations applicable to the business.

Riders using Barqly agree to:

• Provide accurate rider, vehicle, and verification information.
• Remain eligible and authorized to complete deliveries.
• Use location tools honestly when going online and during active delivery.
• Handle orders safely, professionally, and in accordance with platform rules.
• Avoid false delivery confirmations, route manipulation, unsafe behavior, misuse of customer data, or any conduct that undermines trust in the network.

You may not use Barqly to do any of the following:

• Break the law, infringe rights, or misuse the service for fraudulent activity.
• Interfere with the apps, APIs, routing, dispatch, payments, or notification systems.
• Scrape, reverse engineer, copy, or exploit the platform beyond permitted use.
• Abuse promotions, chargebacks, refunds, OTP flows, or support channels.
• Upload false, harmful, infringing, or misleading content or documents.
• Use another person's account, impersonate another party, or misrepresent your role.

Barqly may suspend, limit, or terminate access to the platform where necessary for safety, fraud prevention, policy enforcement, operational integrity, legal compliance, or risk management.

Users may also request deletion of their account through supported flows. Deletion may be blocked while active orders, deliveries, payment issues, or compliance reviews remain open. Certain records may be archived after deletion for recovery, compliance, audit, or dispute purposes.

Barqly aims to keep the service accurate, secure, and reliable, but the platform is provided on an as-available and as-provided basis to the fullest extent permitted by law.

We do not guarantee uninterrupted access, error-free operation, or that every delay, outage, failed payment, or delivery issue can be prevented. To the extent permitted by law, Barqly is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service.

Except where mandatory law requires otherwise, these terms are intended to be governed by the laws applicable to Barqly operations in Nigeria.

We may update these terms from time to time as the product, operating model, or legal requirements evolve. Continued use of the service after an update means you accept the revised terms.
